Case of supervisor’s stolen identity delayed Print E-mail

MODESTO — The criminal case against the Turlock woman accused of stealing a county supervisor’s identity got pushed back again Tuesday.

This marks the third time Stanislaus Superior Court Judge Thomas Zeff has delayed the case against Serena Essapour at the request of her attorney, Mark Geragos.

Geragos, who is best known locally for defending convicted murderer Scott Peterson, requested that the prosecuting attorney be removed from the case. He filed his request with the court Tuesday morning, shortly before the case was scheduled to go before a judge.

Zeff said he would have to grant the request.

“The court doesn’t have any real discretion,” Zeff said. “He’s entitled to have his motion heard.”

Still, Zeff said it was suspicious that Geragos did not file the motion until Tuesday, after he had announced his intention to do so several months ago.

Prosecuting attorney Dawna Frenchie requested that the preliminary trial proceed.

“(Geragos) has had months to file this motion,” Frenchie said. “They’re filing it today just to have the preliminary hearing at another time.”

The judge will hear Geragos’ argument Feb. 11. In the past, Geragos has claimed the district attorney’s office has a conflict of interest because the board of supervisors oversees its budget.

The previous two delays happened after Geragos did not show up for court and requested the trial be postponed. When Zeff granted the second request in December, he said he was not likely to allow any more delays. However, because Geragos was requesting the delay for a different reason this time, Zeff felt compelled to grant the request.

The case against Essapour stems from credit cards she took out using the name and Social Security number of county Supervisor Jim DeMartini. DeMartini is the West Side’s representative on the board.

Essapour, who was involved in local Republican party politics, obtained DeMartini’s Social Security number after he co-signed on a car loan for her.
