Sentencing delayed for convicted rapist as attorney seeks new trial Print E-mail

A man convicted of breaking into a Patterson woman’s home and raping her seeks a new trial.

Genaro Anaya-Fernandez, 42, of Patterson, appeared Monday in Stanislaus County Superior Court, where Judge David Minier ruled that the decision on a new trial would be announced July 3.

Shackled and dressed in an orange-striped jumpsuit, Anaya-Fernandez sat silently in the courtroom as a Spanish-language translator relayed the judge’s decision. He remains in custody as the court considers his request for a new trial.

If that request is dismissed, a judge is scheduled to sentence Anaya-Fernandez that same day. The district attorney’s office is seeking 76 years to life in prison.

In February, a jury found Anaya-Fernandez guilty of raping a Patterson woman after entering her home Dec. 15, 2006. After the verdict was delivered, Anaya-Fernandez’s family hired him a new attorney, Cristobal Perez. He hopes to get his client another shot at a not-guilty verdict.

During Anaya-Fernandez’s trial, the prosecution laid out its version of events. Prosecutors claimed Anaya-Fernandez waited for the victim to be alone in her home. He then went to the door and pretended to deliver a package. When the woman, who was referred to as Jane Doe throughout the proceedings, unlocked the door, Anaya-Fernandez forced his way in, prosecutors said. Doe grabbed a knife to defend herself, but Anaya-Fernandez overpowered her and used the knife against her.

Police found no evidence of Anaya-Fernandez’s DNA or fingerprints at the house.

This week’s appearance was the second time Anaya-Fernandez’s new attorney has spoken in court seeking a new trial. On March 13, he requested that sentencing be delayed until the motion for a new trial could be reviewed. On Monday, he asked the judge for another extension.

He offered no comment on new details in the case but said they would come to light as the proceedings continue.
