Commission rearranges lots for legal settlement Print E-mail

As part of a legal settlement, the Patterson Planning Commission decided Thursday to divide 18.86 acres of land near the sewer treatment plant east of the city.

When Charles Ferry, the other party involved in the settlement, tried to ask a couple of questions at the commission meeting, he was provided with few answers.

“I recommend you speak through your attorney,” Community Development Director Rod Simpson told Ferry.

Simpson said the re-parceling had been proposed by City Attorney George Logan, and any questions regarding the settlement must be directed to him. Logan was not at Thursday’s meeting and does not typically attend commission meetings.

Ferry continued to seek answers, but Simpson replied the same way.

“I guess we’re not going to get anywhere tonight,” Ferry said at last.

The settlement stems from a 2005 lawsuit Ferry filed against the city. The suit claims that expansions to Patterson’s sewer plant damaged Ferry’s property.

Logan said the re-parceling is part of a court-ordered settlement that will allow the city to give land to Ferry in exchange for his property of equal value.

Logan has said the land is worth about $350,000, though Ferry questioned that figure when he addressed the commission.

“You guys are going with whatever George Logan tells you,” he charged. “Right or wrong.”
Ferry declined to comment for this story after Thursday’s meeting.

The commission’s 3-0 vote, with two commissioners absent, allowed for the land to be divided into four parcels. The new configuration would create three 1.66-acre lots and one 13.88-acre lot.

Commissioners told Ferry that they were not reviewing the legal settlement. Instead, they reviewed whether the re-parceling would conform to city ordinances and guidelines.

“We’re dealing with what’s in front of us,” Commissioner Pat Dooley said.

The commission’s decision can be appealed to the City Council.
